Accredited  Buyer’s  Representative 

  • A supervised, optional,  examined  course, adapted and monitored by the American “National Association of Realtors” (NAR).  The A B R Designation Course is powered by REBAC.    REBAC is the world’s largest organization of real estate professionals focusing on BUYER representation. By providing specialized training and ongoing skill development, REBAC helps its members—and the homebuyers who work with them—experience more successful real estate transactions.
  • Buyer representation is the practice of Real Estate practitioners, brokerages and their licensees representing the buyer as a client in a Real Estate Transaction. It focuses on the fiduciary duties in working for advising the client. Those duties  address obedience, loyalty, disclosure, confidentiality, accounting / accountability and reasonable care and diligence.  Agency defines the difference of being a client,  no-agency customer,  or Dual agency situation.   This representation is referred to as buyer agency. The agency relationship between a buyer’s representative and the buyer is legally binding. The relationship can be contractually formalized through a written agreement, called an ‘Exclusive Buyer’s Agency Contract’,  although it is not required.  Fewer than five per cent of Realtors in British Columbia use the Exclusive Buyer’s Agency Contract but it is protection for all concerned and is becoming more necessary, appropriate and acceptable.

Real Estate E & O Insurance – Legal Update 2010

In the 1990s, six or seven claims were reported for every 1000 residential sales in BC.  That rate has now dropped to 3 or four per 1000.  The taking courses like these reduce the likelihood of professional and financial exposure.  We are reminded that when we are doing a good job of protecting our clients' interests, we are doing a great job of protecting our own interests too. What Brokerages and Realtors Need To Know About Agency

The relationship between brokerages, and their licensees and the Buyers and Sellers whom they represent is one of the agency.

An agency relationship imposes certain duties upon brokerages and Realtors.  Any breach of those duties and obligations can have serious consequences, including a loss of professional perception and commissions.

An undertaking of the law as it applies to the relationships entered into by brokerages and Realtors on a daily basis is critical to avoiding problems.  This course undertakes the discussion of general principles of agency law and reviews the various types of agency relationships that are entered into by brokerages and Realtors.  It also applies those principles to fact patterns (keeping current !) that managing brokers and realtors do, or may encounter in the conduct of our business.

Ethics – Unlocking the REALTOR Code

As legal decisions are handed down, they affect the way in which we handle each other. The “Code of Ethics” is continually being scrutinized and re-interpreted in order to keep the highest possible standards of professional and moral conduct in place.  As Realtors handle what is in most cases, the largest single asset  of their clients, refresher courses like these remind us what the current standard has to be.  

Selling  Tenant - Occupied  Properties  ( STOP ) 

What we see and hear in the media are usually the results of the misunderstandings of those people involved in renting or leasing.  A man's home is his castle.  The home owner  believes that because he pays the mortgage and holds title that he has absolute authority over that man's castle.

From a realtor’s perspective, after presenting a solid comparative market analysis  (CMA) and making a truly amazing listing presentation to the Sellers, we are rewarded with a brand new listing to sell. We are told by the Sellers that our new listing is tenant-occupied and, upon notifying the tenants that the land lord has listed the property with us, the tenants become uncooperative. The battle to maintain a good relationship while showing and marketing the property now begins. From the date of notification, the tenants go into  “hiding mode”.  Tenants over a short period of time start to realize that anything they do to assist the showing and selling process is to their ultimate detriment. British Columbia has some of the most tenant protective laws in North America.  Know how to be ushered across  the mote in order to enter this castle !

This course teaches the ‘current law’ and ethics prevailing between the rights of the tenant, the rights of the landlord and the ‘real authority’ that the Realtor has, under current legal guidelines.
